In a divorce situation, you may feel that you did not get the ruling that you wanted or deserved. You have the right to appeal the decision to a higher court called the Court of Appeals.
In order to appeal, you must have a legal reason or basis that is appropriate based on your case and file that appeal within 30 days of the final judgment.
The court recognizes reasons for appeal, such as:
- Legal errors made by the lower court
- Fraud
- Evidence that your Judge did not permit you your rights as you are granted them by the Florida Constitution and the United States Constitution
- An inability by the Judge or the other attorney to properly notify you that a hearing was going on that was going to affect your rights
And this is just naming a few of the reasons why a case should be appealed. This decision is a very serious one to make BUT must be made within a pretty short period of time after your Court Case. It is not to be taken lightly.
